RELEASE, WAIVER OF RESPONSIBILITY, AND ASSUMPTION OF RISK AGREEMENT Textures of Tuscany Workshop – Participant Agreement PLEASE READ CAREFULLY BEFORE SIGNING I understand that participating in the Textures of Tuscany workshop involves inherent risks, including but not limited to those related to transportation, staying at a rented villa (with access to a pool), and engaging in jewelry-making activities. I voluntarily assume all risks, known and unknown, and accept full responsibility for my safety and any injuries or damages that may result from my participation. 1. Acknowledgment of Risks I acknowledge and agree that my participation in the workshop includes the following risks, among others: Transportation risks, including but not limited to accidents, vehicle malfunctions, or incidents during transport to and from the villa or scheduled activities. Villa stay risks, including the potential for injury from using the pool, which may involve slipping, falling, or drowning, and other hazards inherent in staying at a rented property. Jewelry-making risks, including exposure to superheated gases, torches, handling hot metals, sharp objects, power tools, and chemicals. I understand that failure to adhere to safety protocols or improper use of equipment could result in serious injury. 2. Release of Liability I, on behalf of myself, my heirs, next of kin, spouse, guardians, legal representatives, and assigns, hereby release and discharge Davide Bigazzi, Davide Bigazzi Studio, their agents, employees, instructors, affiliates, successors, and assigns (collectively, the "Released Parties") from any and all liability, claims, or causes of action, whether known or unknown, arising out of or related to: Transportation, including travel provided by the workshop. Accommodation, including the use of the villa, pool, and surrounding property. Jewelry-making activities, including but not limited to the use of any tools, equipment, or materials provided during the workshop. This release extends to claims arising from the negligence of the Released Parties, to the fullest extent permitted by law. 3. Assumption of Personal Responsibility I assume full responsibility for my own actions and agree to: Follow all safety instructions and protocols provided during jewelry-making activities. Ensure that I handle tools, equipment, and materials in a responsible manner. Arrange my own transportation if I do not use the transportation provided by the workshop. Protect my personal belongings, as the Released Parties are not responsible for loss, theft, or damage to my property. 4. Medical Consent and Responsibility In the event of an emergency, I consent to any necessary medical treatment and agree to be solely responsible for any costs associated with such treatment, including transportation to medical facilities. 5. Indemnification I agree to indemnify and hold harmless the Released Parties from any claims, damages, or liabilities (including legal fees) arising from my participation in the workshop, including but not limited to claims for injuries or damages to other participants, staff, or property caused by my actions or omissions. 6. Governing Law This agreement shall be governed by and construed in accordance with the laws of Italy. Any disputes arising from this agreement or my participation in the workshop shall be resolved exclusively in the courts of Italy.
